Australian company registration

Foreign or overseas ownership of an Australian company

If you live outside Australia and want to start a business or register a company in Australia, we can help. Subject to compliance with Australia's foreign investment laws (see www.firb.gov.au) you can register an Australian company and be the sole owner or shareholder.

However the Australian Corporations Act 2001 requires that at least one director of a private Australian company must "ordinarily reside in Australia". The company must also have an address in Australia for its registered office and principal place of business.

Other registration requirements

After the company formation (or incorporation) and company registration is complete, you will need to apply for an Australian Business Number (ABN) from the Tax Office before you can start business. You will also need to apply for a tax file number (TFN), GST and perhaps PAYG withholding tax registration. These applications can be made online through the Tax Office website http://www.abr.gov.au/ABR_BC/ or Contact us.
